*******On Farm Breeding Contract*******
This Stallion Breeding Contract is made and entered into on this day by and between Syneva Peters of Edoras Stables, LLC, hereinafter designated Breeder, and _______________________ hereinafter designated Mare Owner. Mare Owner agrees to breed (mare), ________________________, registered with _______________, registration # _______________ for the fee of $_____ to the Stallion, Luck Of the Irish (GCSA #A00000307), on this date _______________________ for the season of ____, subject to the following conditions.
1. The Stallion fee includes a non-refundable booking fee of $250, payable with this contract. The balance of which must be paid before the mare is bred. All other expenses must be paid when the mare is picked up or when the Mare Owner is invoiced, whichever comes first. Invoices are payable on receipt. Second invoicing is subject to a $10 penalty. Past due accounts will be subject to a $20 per month late fee. Mare Owner may not remove mare from Breeders possession until all expenses are paid in full. Small claims action will be taken on accounts past due 90 days. A copy of both sides of the mares papers must accompany this contract, if applicable.
2. Breeder agrees to provide suitable facilities for the care and feeding of the mare and/or foal while in her custody. The mare will be boarded at Doubletree Horse Farm during the breeding season. Mare Owner agrees to pay for care and feed at the rate of $7.00 per day dry or $10.00 per day wet. If foals are not broke to lead, or are unable to be left in the pen alone, there may be an additional $10.00 charge for special handling.
3. Breeder will exercise judgment consistent with recognized standards in care and supervision of mare and/or foal. Breeder assumes responsibility of arranging veterinarian and farrier services as he deems necessary. Breeders veterinarian may examine mare for normal breeding conditions and administer medical care as deemed necessary for the health and safety of the mare and/or foal. All veterinarian and farrier expenses will be paid by Mare Owner before the mare can be picked up from Doubletree Horse Farm.
4. The mare shall be in a healthy and sound breeding condition, free from infectious, contagious, or transmissible disease. A current negative Coggins Test taken no later than 12 months previous, photo static copy of registration papers (if applicable), veterinarians health certificate, plus a health, worming and immunization record must accompany mare. If they do not, Breeders veterinarian will examine and/or test mare at Mare Owners expense. Breeder reserves the right to refuse mare if not in satisfactory condition. If mare is refused, the booking fee shall constitute liquidated damages. Mares that are not halter broken or are extremely hard to handle will not be excepted.
5. Breeder agrees to diligently try to settle the mare; however, if the mare fails to settle, for any reason, Mare Owner will hold Breeder blameless. Mare Owner agrees to give Breeder ample opportunity to settle the mare in a way Breeder deems best.
6. This contract contains a live foal guarantee (foal must stand and nurse). (Also see paragraph 9 for further clarification.) Mare Owner must be able to document and verify all treatments and medications, and that they have done the following:
A) Wormed the mare no less than every 60 days through the entire pregnancy.
B) Given Rhinopneumonitis shots in at least the 5th, 7th, and 9th month of pregnancy.
C) Has kept mare in healthy condition by providing her with ample food and water, and adequate shelter.
D) Has not unduly stressed the mare, especially in the last 60 days of pregnancy.
E) Has followed all instructions given by the Breeder.
F) Has had the mare preg-checked by ultra sound between days 14 and 18 or by palpation by Mare Owners veterinarian between 35 and 45 days after last breeding date. If a mare is determined by a veterinarian to be open, there are return privileges for that season prior to August 1st, or for the following season (March 1st - August 1st). The breeder must be notified within 10 days and must receive a veterinarians statement confirming the unpregnant (open) mare or the loss of a foal that did not stand to nurse.
7. A Breeders Certificate will be issued for the foal, conceived by this mating, when the stallion fee and all other expenses have been paid in full and when the mare has produced a live foal by this mating.
8. Both parties agree the Edoras Stables, LLC, the Breeder, their agents or employees are not liable for death, sickness, and/or accident including consequential damages caused to the mare and/or foal.
9. It is further agreed that should the stallion die, be sold by the owner, or become unfit for service prior to settling the mare, that the breeding fee will be refunded, if it has been paid in full, thereby canceling this entire contract. If mare dies or becomes unfit to breed before being pronounced safe in foal, foal dies before being able to nurse, or mare loses foal before birth, the Breeder has the following options: (a) accept another mare according to the paragraphs above, as a replacement if necessary, or (b) refund half of the breeding fee that has been paid, thereby canceling this entire contract. (The booking fee and mare care are non-refundable, and therefore will not be considered part of the breeding fees considered in this paragraph).
10. This Contract is non-assignable and non-transferable. Breeder recommends that Mare Owner carry full Equine insurance on the mare and/or foal. This Contract in entered in the State of Colorado, and will be interpreted and enforced under the laws of the state.
11. This Contract represents the entire agreement between the parties. No other agreement or promises, verbal or implied, are included unless specifically stated in this written Contract. When Mare Owner and Breeder sign this Contract, it will then be binding on both parties, subject to the above terms and conditions.

This Stallion Breeding Contract is made and entered into on this day by and between Syneva Peters of Edoras Stables, LLC, hereinafter designated Breeder, and _______________________ hereinafter designated Mare Owner. Mare Owner agrees to breed (mare), ________________________, registered with _______________, registration # _______________ for the fee of $400 to the Stallion, Rugged N Classy (APHA # 925,585) a.k.a. Shakespeare, on this date _______________________ for the season of 2008, subject to the following conditions.
1. The Stallion fee includes a non-refundable booking fee of $150, payable with this contract. The balance of which must be paid before the mare is bred. All other expenses must be paid when the mare is picked up or when the Mare Owner is invoiced, whichever comes first. Invoices are payable on receipt. Second invoicing is subject to a $10 penalty. Past due accounts will be subject to a $20 per month late fee. Mare Owner may not remove mare from Breeders possession until all expenses are paid in full.
